Judge Richard Cebull Story – Gerry O’Brien at MtnStandard.com Censors Comments Beyond His Reading Comprehension

So, we made the following comment on this story about Judge Cebull who sent a joke that is off color and okay, so what.  Turn on late night every night and you’ll hear more of the same. 

How often do you hear: “Cebull took responsibility, calling it ‘a hard lesson to learn. I apologize.'”    We applaud the man’s integrity to apologize in a public forum.

But OUR comment was removed by Gerry O’Brien who is proud of his down home censorship when the comment doesn’t agree with his target market red necks with 5th-grade spelling and vocabulary.  Mr. O’Brien doesn’t want anyone “smarter than him” commenting on his story because then he might be challenged himself.  Whoa nelly, cowboy!   Here’s our comment:

Give me a break – Would you rather have a judge tell a bad joke or a judge violate your constitutional rights because you are a pro se litigant filing a Section 1983 Civil Rights Complaint? Are you going to investigate this guy? Before you do, investigate U.S. District Court Judges David O. Carter, Josephine S. Tucker, and Dolly M. Gee FIRST, then see how bad you feel about a stupid mistake by a good man.

O’Brien claims, “If you don’t see your comment, perhaps you called someone an idiot, a racist, a dope, a moron, etc. Please, no name-calling or profanity (or veiled profanity — #$%^&*).you rambled, failed to stay on topic or exhibited troll-like behavior intended to hijack the discussion at hand.  YOU SHOUTED YOUR COMMENT IN ALL CAPS. This is hard to read and annoys readers.  you have issues with a business. Have a bad meal? Feel you were overcharged at the store? New car is a lemon? Contact the business directly with your customer service concerns. you believe the newspaper’s coverage is unfair. It would be better to write the editor at editor@mtstandard.com, or call Editor Gerry O’Brien at 406-496-5513. This is a forum for community discussion, not for media criticism. We’d rather address your concerns directly. you included an e-mail address or phone number, pretended to be someone you aren’t or offered a comment that makes no sense. you accused someone of a crime or assigned guilt or punishment to someone suspected of a crime. your comment is in really poor taste.

mtntamer, learning your correct screen name is not important because the chance of having to use it in the future is very unlikely, but if you plan to communicate with other people, I suggest you should learn the correct spelling for “their” not thier the way you used it in your previous response to me.

If someone sent you such a racist joke, you should have let them know it is innapropriate and to never send anything similar to you again. Not doing so makes you complicit in an extremely ugly practice.

The comments made by this so-called judge were vile, repulsive and racist. This is why people don’t feel the judicial system is always fair. A judge is supposed to be above reproach in terms of their character and ability to be fair and just. Would you want to go before a judge who showed an obvious resentment against Jews, Catholic’s, gays, Irish, Italians or any member of any race, religion or creed? This judge is an embarrassment to bench and should resign immediately. How can any Black American feel they could receive a fair and unbiased verdict from a man as despicable as this? This is in no way a reflection on the great state of Montana and its people, but an indictment of this judge and no one else. No one should ever joke at the expense of another persons character.

The Supreme Court can override the Constitution and appoint the President, just like they did George Bush The Dumber?

No, this is just the kind of guy they’re looking for.

The honored scales of justice are always unbalanced when judges are appointed to the bench by very partisan parties who hold the power in a given legislative district.

Judge Cebull sits on the bench in Billings, a very powerful conservative district in Montana. There is no surprise in the fact that Judge Cebull does not personally agree with President Obama’s actions; Republicans all over the country have vowed to see that President Obama is not re-elected to a second term.

What is so very shocking and totally unacceptable, is that this email sent to just a few close friends, is more about race–yes, President Obama’s skin is definitely darker than those of us who are of caucasian descent–and this decidely and overtly racist “joke” was not funny, and certainly not appropriate to forward to even one person. Had I been sent this disgusting racist “joke,” I would have hit the delete button.

Personally, I would never trust Judge Cebull to set aside his biases about ANY issue that comes before him.

I’d like the judge to explain his conduct in light of his obligation to abide by the Code of Conduct for United States Judges; in particular how his behavior comports with the obligation to act “at all times in a manner that promotes public confidence in the integrity and impartiality of the judiciary”.


I attended a law school lecture by the late US Supreme Court Justice Lewis F. Powell, Jr. circa 1975, in which he discussed how seriously he took that obligation, and how it influenced his private, not just his public, behavior. He mentioned how he took pains to discuss that obligation with his family and friends.

All federal judges should do the same. Let Judge Cebull’s failing be a lesson to them.

Judge Cebull says no one has asserted that he is a racist. Well, let me be the first to do so then: Judge Richard Cebull is a racist.

Cebull needs to be removed from the bench. Non-white defendants obviously don’t stand a chance with him. And he has been using his government-provided computer to spread his right-wing racist venom among his “buddies” — a clear violation of several policies.

This incident should remind us that not all Republicans are racists but that all racists (like Cebull) have a comfortable home in the Republican Party.

I am a Christian and I am very offended by this judge not only that he forwarded the message but that he actually read it and it didn’t just turn his stomach. I have become very fearful for our country because these (judge) are the people who are running it. I will never respect this judge’s office since he has NO RESPECT for the office of the PRESIDENT of the UNITED STATES. How far have we fallen? This judge is a GUTLESS WONDER!!!
